ONLINE BANKING AND BILL PAY TERMS AND CONDITIONS
Words most often used in this document:

  1. The terms you and your refer to Customers of the Bank who use United Savings Bank Online Banking.
  2. The terms "we" , "us" and "our" refer to the bank that provides the United Savings Bank Online service to you, namely, United Savings Bank.
  3. The term "Payee" refers to the merchants or other persons scheduled to receive payments using Online Banking services.
  4. The term "PIN" refers to your personal identification number that you selected when you enrolled in United Savings Bank Online Banking.
  5. Metavante refers to Electronic Bill payment service provider.

You may access your account(s) by computer 24 hours a day using Internet Access, a user ID number, and password to:

Designation of Primary Account
In order to use United Savings Bank Bill Pay, you must designate a checking account as your "primary" account on your application and this account will be treated as the primary account for bill payment transactions processed through United Savings Bank.

All accounts that you are the PRIMARY account holder on will appear on your Account Overview screen. If you own a joint account and you are not the primary account holder, then this account will not be displayed. You will have the ability to transfer funds between accounts with United Savings Bank online. Transfers will not be allowed from or to Certificates, IRA' s or any Loan Accounts.

Services Available through United Savings Bank Online Banking
Online services allows you to:

    1. Access your primary checking account to pay all bills (Bill Pay).
    2. Transfer funds electronically between statement accounts.
    3. Obtain account information, such as statement history.
    4. Order checks and request stops payments.
    5. View your cleared checks electronically.

General Information about United Savings Bank Online Banking
You may use United Savings Bank Online Banking virtually anytime, day or night, 7 days a week, Member service is available through Metavante, the banks bill pay provider at 1-866-482-6945. Sometimes United Savings Bank Online Banking may be temporarily unavailable due to record updating, or technical difficulties. United Savings Bank Online Banking with Bill Pay is made available pursuant to a license agreement between United Savings Bank and Metavante. Any interruption or service or access caused by Metavante will also prevent your use of the service.

Bill Pay Transaction Procedures
Bill Payments may be processed in three different transaction modes. They are as follows:

    1. "Today" . If you designate a payment or transfer as a Today transaction the scheduled initiation date will be the next business day. However, sufficient funds must be available on the day and at the time you request the Today transaction. Today bill payments may not be canceled for any reason once you have ended a United Savings Bank Online Banking session, as funds are immediately deducted from your primary checking account.
    2. "Future" . If you designate a bill pay transaction or transfer as a Future transaction, you may request that the transaction be made on a future date that you may designate up to 364 days in advance of the Scheduled Initiation Date. The processing date will be the effective date that you entered, or the next business day should the effective date fall on a weekend or holiday. Sufficient funds must be available by midnight of the night before the processing date, but will be deducted from your primary checking account on the Scheduled Initiation Date. Future transactions may be canceled or changed 24 hours prior to the Scheduled Initiation Date.
    3. "Recurring" . If you designate a bill pay transaction or transfer as a Recurring transaction, you may request, and the bank will use, a Scheduled Initiation Date that recurs on a specified regular basis (i.e. weekly, biweekly, monthly, etc). You will designate a start and end date. Sufficient funds must be available by midnight of the night before the Scheduled Initiation Date. Recurring transactions may be canceled or changed 24 hours prior to the Scheduled Initiation Date.

Bill Pay

    1. Account Designation and Payees. All bill pay transactions you make through United Savings Bank Online Banking will be deducted from your primary checking account. Any payee you wish to pay through United Savings Bank Online Banking must be payable in U.S. Dollars and located in the United Sates. Each payee must appear on the payee list you create with the bank and the account you are paying with must be in your name. It is not advisable that you use United Savings Bank Bill Pay to make payments to a federal, state or local government tax unit.
    2. Processing. Funds will be taken out of your primary checking account on
      the Scheduled Initiation Date entered by you. In many cases, your Bill Payments are electronically delivered to the payee within four business days after the Scheduled Initiation Date. However, some payees are not set up to accept electronic payment. In these cases, a check will be sent, which may take up to ten business days to process and deliver to the payee.
You must allow sufficient time (4 to 10 business days) for us to receive your request and process the Bill Pay transactions so that funds can be delivered to the payee before the payment due date (the due date shown on the invoice or provided in your agreement with the payee, not taking into account any grace period provided by the payee). If you do not allow sufficient time, you will assume full responsibility for all late fees, finance charges, or other actions taken by the payee. If you schedule your payment with sufficient time, and the payment was not received by the payee, or was received late, Metavante will assume responsibility.

United Savings Bank and Metavante are responsible only for ordinary care in making payments upon your authorization and for mailing or sending a payment to the designated payee. United Savings Bank and Metavante are not liable in any way for damages you incur if you do not have sufficient funds in your account to make the payment on the processing date, if the estimate of time allowed for delivery to the payee is inaccurate, due to delays in mail delivery, in changes of merchant address or account number, the failure of any merchant to account correctly for or credit the payment in a timely manner, or for any circumstances beyond the control of the bank or Metavante.

Limitations of Service

  1. Dollar Limits. There is a daily dollar limit of $9,999.99 on any payment or Online Banking transfer.
  2. Transfer Limitations. Except as provided herein, all Bill Pay transactions and transfers to and from an account are subject to the terms and conditions applicable to such account as set forth in the account terms and conditions of each account. With respect to Statement Savings Accounts and Money Market Accounts during any calendar month, you may not make more than six transfers, or withdrawals, from your account or to third parties, when these transfers are made by means of a preauthorized or automatic transfer, or telephonic order or instruction.
  3. Available Funds Required. All bill pay transactions and transfers initiated through United Savings Bank Online Banking are subject to there being sufficient available funds in the affected account to cover the transfer on the effective date of the transaction.

Stopping or Modifying United Savings Bank Online Banking authorized payments
Payments designated as "Today" transactions cannot be stopped, canceled, or changed once your United Savings Bank Online Banking session is terminated. Except as stated below, in order to request a stop payment on a United Savings Bank Online Banking transaction designated as "Future" of "Recurring", you must cancel or change the payment or transfer using United Savings Bank Online Banking at least 24 hours prior to the scheduled processing day.

Security Procedures
A password will be assigned to you for Online Banking security purposes. The password is confidential and should not be disclosed to third parties. You are responsible for the safekeeping of the password. You agree not to disclose or otherwise make the password available to anyone not authorized to sign on your accounts.

You represent that you have considered the security procedures of the United Savings Bank Online Banking and find that the security procedures are commercially reasonable for verifying that a Bill Pay transaction, transfer or other communication purporting to have been issued to you is, in fact, yours. In reaching this determination, you have considered the size, type, an frequency of Bill Pay transactions, transfers or other communications that you anticipate processing through the bank. If the United Savings Bank Online Banking security procedures are not, in your judgement, commercially reasonable, you must inform us within 30 days. If the size type and frequency of Bill Pay transactions or transfers change, and the result is that the United Savings Bank Online Banking security procedures cease to be commercially reasonable, you must also inform us of this within 30 days.

Documentation and Verification of Payments and Transfers

    1. Confirmation Numbers Upon completion of Bill Pay transactions and account transfer using United Savings Bank Online Banking, a confirmation number will be given. You should record this number, along with the payee, scheduled date and transaction amount in your checkbook register (or other permanent record), because this will help in resolving any problems that may occur. No printed receipts are issued through United Savings Bank Online Banking.
    2. Periodic Statements Information concerning United Savings Bank Online Banking transactions will be shown on your monthly statement for the account to and from which transfers are made.
    3. Recurring Deposits If you have arranged to have deposits made to a deposit account at least once every 60 days from the same person or company, you can find out whether or not the deposit has been made through United Savings Bank Online Banking or you can use our Bank By Phone system to find out whether or not the deposit has been made.

Other Conditions
You are responsible for complying with all terms of this agreement and disclosure and the regulations governing the deposit accounts which you access using United Savings Bank Online Banking. The regulations governing your deposit account are set forth in your deposit Agreement and Disclosures.

Fees and Charges.
Use of United Savings Bank Online Banking is provided free of charge. However, if you elect to use our Bill Payment Service, there may be a monthly charge. There is no charge if you maintain a minimum balance $5,000.00 in your Primary Checking Account. If your balance falls below $5,000.00 there will be a monthly charge of $5.95 for the first 15 transactions made. If you exceed 15 monthly transactions there will be an additional charge of .75 per transaction. If you use United Savings Bank Online Banking to place a stop payment, then our normal Check Stop Payment Fees
will apply as provided in our Service Charges and Fees Schedule.Fees are subject to change without notice.

as soon as you can if you think your statement is wrong or if you need more information about a transfer listed on the statement receipt. We must hear from you no later than sixty (60) days after we sent you the FIRST statement on which the problem or error appeared.

  • Tell us your name, account number, and payee, if applicable
  • Describe the error or the transfer you are unsure about, an explain as clearly as you can why you believe it is an error or why you need more information.
  • Tell us the dollar amount or the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days.

We will tell you the results or our investigation withing ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty five (45) days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days for the amount you think is in error so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit your account. If we decide that there was not error, we will send you a written explanation of our findings within three (3) business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation. If a notice of error involves an electronic fund transfer that was initiated in a foreign location, the applicable time periods for action shall be twenty (20) business days in place of ten (10) business days, and ninety (90) days in place of forty five (45) days.

Changes in Terms
We will mail or deliver a written notice to you at least 30 days before the effective date of any change in term or condition disclosed in this Agreement and Disclosure if the change would result in the increased liability for you, fewer types of available electronic funds transfers or stricter limitations on the frequency or dollar amounts of transfers, unless prior notice is excused by law.

Canceling United Savings Bank Online Banking
You may cancel your use of United Savings Bank Online Banking at any time by sending an electronic message to the bank or by calling 215-467-4300 . If you notify the bank by phone, we may require you to put your request in writing. You cannot cancel until all pending payments have cleared. If you have pending payments and do not want to wait for them to clear, your must individually delete these future payments.

Liability for Unauthorized Use
You must notify us immediately if you believe that your password has become known to an unauthorized person. We may require you to provide your complaint in the form of an affidavit. If you do not tell us within 60 days after we sent you the first statement on which the problem or error appeared, you may not get the money back. Also, if your statement shows electronic funds transfers that you did not make, you must notify us immediately. We may require you to provide your complaint in the form of an affidavit. Notification of Unauthorized Transaction
If you believe that someone has made payments without your permission, you may call Metavante 1-866-482-6945.

Liability of Failure to make Payments
If we do not send a payment or make a transfer on time, or the correct amount according to your instructions given in accordance with this Agreement and Disclosure, we will be liable for damages caused. However, there are some exceptions. We will not be liable, for instance, if:

    1. Through no fault of ours, your account does not contain sufficient funds to make the payment or transfer.
    2. The equipment, ATM network, phone lines, or computer systems were not working properly or were temporarily unavailable.
    3. Circumstances beyond our scope of control, such as fire of flood, prevented the payment or transfer, despite reasonable precautions we have taken.
    4. A court order of legal process prevents us from making a transfer or payment.
    5. You have previously reported unauthorized use of your password, or if you default under any agreement with us or if you or the bank terminate this agreement.
    6. The payee does not process a payment correctly, or in a timely manner.

There may be other exceptions stated in our agreement with you.

If any circumstances listed should occur, we will assist you with reasonable efforts in taking appropriate corrective action to reprocess the transactions that may not have been completed or to correct transactions that have been processed incorrectly.

LIMITATION OF LIABILITY. UNLESS OTHERWISE REQUIRED BY LAW WE WILL NOT
BE RESPONSIBLE FOR ANY LOSSES OR DAMAGES FROM THE USE OF UNITED SAVINGS BANK ONLINE BANKING SERVICES DESCRIBED IN THIS DISCLOSURE STATEMENT AND THE UNITED SAVINGS BANK ONLINE BANKING HOME BANKING AGREEMENT OR THE SOFTWARE, INCLUDING DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR LOSSES. WE WILL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES BECAUSE OF A FAILURE OR DELAY IN THE DELIVERY OR PROCESSING OF ANY BILL PAYMENT.

Enforcement. In the event either party brings a legal action to enforce this agreement or collect amounts owed as a result of any account transaction, the prevailing party shall be entitled to reasonable attorney s fees and costs. Including fees on any appeal, subject to any limits under applicable law. Except for equitable relief enforcement and resolution of disputes under this Agreement. This Agreement shall be governed by applicable federal law and by the laws of the Commonwealth of Pennsylvania without regard to its rules on conflicts of laws. The contents of this Agreement apply to both the Internet and Direct Dial access versions of United Savings Bank Online Banking, except where otherwise stated. This Agreement is subject to the terms of the primary agreements governing the customer's accounts with the Bank. In the event of a conflict between this Agreement and the primary account agreements, the primary account agreements shall prevail.

Electronic Stop Payment Service. You may use United Savings Bank Online Banking to place a stop payment order on your account. If you use this service, you agree to the following terms and conditions:

  • The stop payment order is effective for six (6) months unless renewed in writing or through United Savings Bank Online Banking.
  • The information on the stop payment order must be correct, including the exact amount of the check, the check number, the date and the payee.
  • You understand that there may be claims or demands made against us as a result of your request to us. You agree that you will be responsible to us if any claim or demand is made against us as a result or us having acted as you requested. You agree to reimburse us for any reasonable costs, expenses or attorney's fees that we have incurred in defending ourselves against any such claims or demands.
  • Requests made before 3:00 p.m. are entered on the current day and effective one business day after receipt. Requests made after 3:00 P.M. or on Saturday, Sunday, or a Federal Holiday are entered on the next business day and will be effective on the second business day after receipt.

Termination of United Savings Bank Online Banking Services.
You agree that we may terminate this Agreement and your use of the United Savings Bank Online Banking services if:

  • You or any authorized user of your PIN breach this or any other agreement with us;
  • We have reason to believe that there has been an unauthorized use of your PIN.
  • We notify you or any other party to your account that we have canceled or will cancel this Agreement. You or any other party to your account can terminate this Agreement by notifying us in writing. Termination of service will be effective the first business day following receipt or your written notice.

Termination of this Agreement will not affect the rights and responsibilities of the parties under this Agreement for transactions initiated before termination.

Account Information Disclosure
We will disclose information to third parties about your account and the payments and transfers you make:

  1. When it is necessary for verifying or completing payments or transfers, or resolving a problem relating to a payment of transfer.
  2. In order to verify the existence and condition of your account for a third party, such as a credit bureau.
  3. In order to comply with government agency or court orders.
  4. To any subsidiary or affiliate.
  5. If you give us written permission.
  6. As otherwise permitted in the United Savings Bank savings deposit agreement and disclosures, by law, or as required by government regulations.
